The first part of the afternoon will be devoted to the impact of artificial intelligence (AI) on the world of work, with a focus on its legal implications. An analysis will be carried out of how this digital revolution is contributing to changes in everyday working practices and their legal context.
The topic of whistleblowing will then be examined in greater depth, at the intersection between the employee’s duty of diligence and loyalty (Art. 321a CO) and the duty of confidentiality and respect for secrecy connected with one’s workplace.
This will be followed by a presentation on the termination agreement for employment contracts, namely an agreement, not expressly provided for by the CO, through which an employment relationship is dissolved. Based on contractual freedom, this instrument nevertheless presents certain critical issues: an agreement drafted inadequately or concluded under pressure may in fact be challenged.
Last but not least, the final part will be devoted to the Labour Act (LL) and recent case law developments in the areas of health protection, working and rest time, night and Sunday work, as well as other special protections.
