The meeting will provide an opportunity to analyse the main current issues in this field, with particular attention to reform prospects and the application challenges affecting authorities and professionals in the real estate law sector. The first part of the seminar will be devoted to the evolution of the LAFE and the prospects for revising the legislation. The main legislative developments and the new features contained in the preliminary draft currently under consultation will be presented, highlighting their possible practical implications.
This will be followed by an in-depth examination of the relationship between the LAFE and real estate development models based on condominiums, with particular attention to hotel and para-hotel structures, such as aparthotels. The analysis will focus on the main legal issues that such projects raise in the context of the application of the Lex Koller.
The third presentation will be devoted to indirect acquisitions of real estate. Through an examination of the most recent developments, transactions carried out through corporate structures and trusts will be analysed, with the aim of clarifying the limits and conditions laid down by the text of the law and, in particular, by the recent case law of the Federal Supreme Court.
The final session of the study afternoon will be devoted to the assessment of the existence of a domicile in Switzerland for holders of an EU/EFTA B permit. This criterion represents a central element in defining the concept of a person abroad within the meaning of the LAFE and plays a decisive role in both direct and indirect real estate acquisitions. The topic will be addressed through the analysis of significant case-law examples.
