Care activities, especially invasive ones, particularly when delivered in modern high-complexity settings, involve clinical risk-taking. In the case of an adverse outcome, questions of a medico-legal and liability assumption nature arise and various procedures, criminal, civil and/or administrative, are playfully intertwined. In the current context, the patient who is a victim of error and the health care provider - himself a potential "victim" - struggle to talk to each other and confront each other, as there are too many formal constraints imposed, in a game of distinct roles.
Last year, a number of error management systems had been explored in depth through the implementation of specific tools - such as, for example, CIRS - aimed at supporting reporting by healthcare professionals in order to take preventive and corrective measures in favor of patient safety. This year, at the end of the 2nd edition of the CAS Diritto sanitario offered by SUPSI, the conference intends on the one hand to recall the historical evolution and state of the medical art and on the other hand to take a look at alternative models already in place in other countries, which favor amicable resolution approaches between health care providers and facilities and the patient victim of an error. Doctors, lawyers and representatives of the Judiciary who deal with these issues on a daily basis, each in their own role, will speak.
