The SUPSI Tax & Legal Competence Centre (CCTG) is organising an afternoon study session during which recent legislative developments will be presented and several highly topical issues in the field of real estate law will be analysed. The first part of the afternoon is devoted to the statutory mortgage securing condominium contributions. The evolution of practice relating to Article 712i of the Civil Code (CC) will be examined, with particular reference to the conditions and limits for obtaining a real estate pledge in favour of the community of condominium owners. In addition, the prospects for reform of condominium ownership law (PPP) will be illustrated, which should lead to a strengthening of the community’s ability to obtain guarantees for contributions, bringing the statutory mortgage of condominium owners closer to that provided for building rights pursuant to Articles 779i et seq. CC.
The second part is devoted to the amendments to the Civil Code and the Code of Civil Procedure (CPC), which will enter into force on 1 July 2026, concerning the unlawful occupation of real estate. After an overview of the origins of this legislative development, the new rules aimed at strengthening possessory protection in cases of unlawful occupation (in relation to the issue of so-called squatters) will be presented, in particular the adjustment of the time limit for recovering possession, as well as the new instrument of the judicial order, which will make it possible to order eviction and restitution of the property also against unknown persons.
The third part is dedicated to eviction proceedings in tenancy law. An analysis of the procedure will be proposed, with particular attention to judicial protection in manifest cases, as well as to the practice and case law developed in the Canton of Ticino, in order to provide a practical overview of the main conditions and application issues of the institute. Last but not least, the final part will be devoted to the tax deductibility of payments to the PPP renewal fund in light of the reform concerning the abolition of the imputed rental value, which is expected to enter into force on 1 January 2028. The possibility of carrying out tax planning through the creation of a provision permitted under current law will be assessed, followed by the execution of maintenance works over the next decade.
